From the district attorney---
Anchorage District Attorney Adrienne Bachman announced that a yesterday convicted James Louis Hall of three counts of theft in the second degree, one count of theft in the third degree and one count of fraudulent use of an access device. In a subsequent bench trial this morning, Superior Court Judge Michael Wolverton found Hall guilty of violating his conditions of release while on bail for the charges.
According to Assistant District Attorney Brittany Dunlop, who prosecuted the case, the evidence presented at trial established that James Hall stole a wallet belonging to a local cab driver that contained all of her credit cards and identification documents, along with several religious medallions. Hall later was caught on video attempting to use one of the stolen credit cards at the Gaslight bar downtown. He was arrested by police a few hours later down the street at the 515 Club. Judge Wolverton found that he violated his bail in this case by leaving his court appointed third party custodian and failing to remand himself to the jail as ordered by the court.
Hall committed this theft offense while he was on bail for another criminal case in which he attempted to use a stolen credit card at Title Wave Books. Hall was convicted after a jury trial in that case and was sentenced in August, 2007.
Judge Wolverton scheduled sentencing for July 18, 2008. The law provides for a total sentence, per count, of up to five years in prison, a fine of up to $50,000, or both. Under the sentencing law, the actual sentence imposed is based on the seriousness of the offense(s) and the criminal history of the defendant. Hall faces a presumptive sentence range of three to five years on each of the three counts of theft in the second degree, and up to one year for each of the three remaining counts.
Officer Shelia Bender, Sergeant Robert Glen and Detective Jean Dupuis of the Anchorage Police Department conducted the investigation that led to the successful prosecution.
