It was with great sadness that I read of this decision. I'm grateful that at least 3 members of this ONCE most esteemed judicial panel disagreed. However, majority carries the vote. After the Supreme Court's decision in the Kelo v. City of New London eminent domain issue I felt the time had come for term limits on this court. This only solidifies my convictions. However, don't give the three dissenting justice's too much credit. They were among the 5 justices who voted pro in the eminent domain verdict. Perhaps conscience played a part in this decision which should be rightfully renamed Big Business v. The Little Guy. I want my country back!

First and foremost, the Stupreme Court sided with a fellow peer to reduce a judgement against his (Justice Alito) company stock and it definately weighed into their decision. Second, the Exxon lawyers did their job and greased the wheels of justice until those wheels fell right off. Commendable on their part because they strung this whole ordeal out way beyond any reasonable timeline and in the process, a quarter of a persons life. It is a broken system that drags out an outcome and makes the justice system an IN-JUSTICE! The honorable Judge Holland is the only one in this case to make a just and logical decision. Why waste the time of jurors deciding on a case if the justice system is going to pull the rug right from under them. What a waste of time and emotions for this to go on so long, it was a textbook case of "public amnesia" gone bad. Finally, the "When the Hell Freeze Over" trial is finally over, so we can all go back to life again and feel warm and fuzzy about our justice system, just like the time we felt it during the O.J. trial. Hey guess what, "O.J. LOVES COMPANY"

Judges Siding with their fellow judge who own's Exxon stocks.
110% positive that the Judges who voted against us fishermen were siding with their fellow Judge. All Judges have the same additude what they learned from Verious Law School that they attended, they are teached not to have any feeling about the clients only for them selves what they think is right. It is not alway's right what the judge think is right. The Judges who voted for us were forced to vote no so the 9th circute coourt could look good in a small way, they just wanted us to think that they do have feelings for us, but in real life they DON"T.. Exxon only lost pennies with 507 million, thats penny money to them when they profit an average of a trillion each year.

It's no wonder that the new breed of young American business people lack ethic. Look at the example our leaders in the Supreme Court put forth. Will this new generation of yuppies boycott anything? Hell no. It's their complacency with government in general that put us here. It's payday for the young spoiled America. It's really too bad that all have to shoulder the burden.

If folks want to lawfully protest this then one must BOYCOTT EXXON and its related companies and must tell everyone you know to quit buying EXXON PRODUCTS. Alaskans have been "VIOLATED" by the coordinated activities of EXXON and its parasitic Attorneys. What else is new. Obama as a SOLUTION!?!?? GET REAL! He wants to punish America and Americans. Flee Barack Hussein Obama. If Obama gets in he will take steps to cause the rice of oil to go up more than George W. Bush allegedly did....

let me start here you go head and vote for that crazy,fruitcake obama and see what he dose to alaska.you think 5.00 for gas is bad now just wait.he dose not want any oil drilling no gas drilling.tell me how we pay to heat our house this winter? people think that it is big oil doing this but its the market that drives the oil prices up and the fed cuts making our dollar weak.if i had a companys that made 10 billion in profit are you going to take my money to.how about going after warren buffet or bill gates there companys made more then some state bugets.so if you made that kind of money you wont mind been taxed to death and have people blame you for the goverments scerw ups.just think about it do you want them in your pockets taken from you.the blame needs to go where it is to blame that is big goverment .we need to start to be indapendent again let the state worry about it.where is america today its not what i remember???

A lesson learned in Kindergarten (PG-13)
It all started in a little town (Valdez) and took place in a time when the future was but a dream, as long as you got your nap (All Fisherman). But when you (Exxon) soil your pants in class (The Sound), no worries, eventually it will get smeared and washed away. Don't admit it was your fault (The Company Lawyers) because if you sense that noone smells it (The Oil Globs), you'll be able to once again go back to class (The State of Big Oil) and act like nothing happened (Georgie Porgie/EXXON shareholder). Eventually the principal (The Gov) will punish that person when there is evidence of "foul play". The proof is in the pudding, Georgie Boy, now it's time to "Kiss the Girl" and run away, far... far...away.......

Don't drag this out any longer. No more appeals. Gee, I wonder why so many are losing faith in our legal system. We need our state politicians to pressure exxon (finally) into ending this once and for all or else get exxon out of our state. We don't need them here, there are other, hopefully more responsible, companies.

Lets get a grip here folks. Those who lost a season's fishing, a home, a boat or had other actual, measurable loss due to the spill should be compensated - liberally - but they have no reason to expect a penny beyond what it takes to repair their actual loss. Anything more than that is simply greed and a lame attempt to get something for nothing. Those who had no measurable financial loss, but want compensation because their tender feelings for PWS were offended are simply opportunists who don't want to work for their money. Lets quit supporting the whiners and get those who suffered actual losses compensated and move on.

Blame the lazy fisherman who don't want to work
Those fisherman wanted the spill to happen so they could get out of work and hire some opportunistic evil lawyers. They are all lazy whiners who want handouts for nothing. Why not just get a slope job like me and work 6 out of 12 hours each day and get paid lots of overtime. Exxon greases my skids, they could grease yours too.

One of the best things we could do to help our country would be to change the law so that attorneys and plaintiffs in tort litigation would not receive any portion of damages beyond actual measurable financial losses.
Punitive damages and awards for "pain, suffering and emotional trauma" should be divided among various charities not associated with the litigation. That would not only remove the incentive for plaintiffs to take indecent liberties with the truth in hopes of getting rich off a lawsuit, but it would remove the incentive for trial lawyers to take on litigation that is patently ridiculous and counterproductive for the community at large.
Those injured physically or financially should be compensated liberally for their actual losses, including court costs and attorney's fees, but creative "damages" and punishment for bad behavior by the defendant should be paid to agencies and organizations that actually benefit the community.

Have you actually read the history and carelessness that has taken place prior to the actual spill? Or the promises made by Exxon to protect the area? Perhaps if you did you would realise that even using your theory the communities are not getting near what they should for damages to their coastlines....not to mention loss of liviliehood for many people. What incentive does Exxon have to prevent this from happening again? This has in no way been a financial issue for them.....they were able to write all the cost off, they will also be receiving a settlement from the processors that settled with them...not to mention what happens to the interest that has been accruing on the original judgement.
The concept behind punitive is for there to be consequences......do you truly see that there have been any?

made money off the spill. they collected interest off the original 5 bill for fourteen years. the 507 mill is a small part of that interest.now they are not wanting to pay interest to the claimants on the 507 mill. what were those judges thinking?

And obviously you don't know anything about punitive damages laws. Punitive damages are to deter and punish for reckless actions. By being paid to the claimants, these damages are also for undeclared or indeterminate compensatory losses incurred by those harmed. Any award to charities, or others would not compensate those harmed for actual indeterminate damages. It is up the to the jury to decide if those claims are embelished or so called "indecent liberties." By the way, how would you divide the punitive damages for those having personal injury loss, since that is indeterminate over a period of time and in which actual compensatory damages may fail exponentially short in these days of high medical expenses. Also, it is the States responsibility to collect for social harm without a direct nexus to the claim. And your solution would do nothing to alleviate the legal system, either in delays or appeals to any awards divided among a States citizens. A private claim is just that. Private, and not open to those outside of the claim, including any punitive awards.

Yes, You Can Help! It will cost you...
If you are serious about "getting back at Exxon", there is a way--there is only one way. You will have to put your money where your mouth is--check your 401K and see if there is Exxon stock there. Call your broker or account manager and request it be removed. Write the Governor and request the State of Alaska remove it's huge investment of the PFD in Exxon stock. The ONLY thing Exxon cares about is it's bottom line and stock price. Everyone in that corporation has stock, and so do you, probably. Tell everyone you know to DUMP EXXON STOCK, NOW!

Yes! A plan of action, not just words. Governor Palin needs to hear from us. If Exxon stock is part of our PFD, we are accepting blood money. Get Exxon stock out of our PFD, and out of our state, and they can take their single hulled tankers with them.

Please don't drop this story...The national news has moved on, but there is much fodder here for follow up stories...Please don't follow suit...the lawsuit may be over, but the effects of the oil spill continue on in the lives of the people and wildlife of Alaska. It is our halocaust...and we need to NOT let people forget

Why increased domestic drilling will not solve inflated gas pric
With all due respect to the many people whose lives were ruined by this spill, and with regards to the pittance that exxon will pay, I would like to take this opportunity again to show why opening ANWR will not make things better at the pump. To those who believe in McCain and Bush's push to open domestic drilling, I bring you this article as one argument to consider as reason why they are wrong.

The decision was very deflating, but life goes on. Alaskans have the wherwithal to tough it out. One is left with a series of emotions, from disgust to reservation. It is sad that politics and law are so intertwined in this country. But, this country is seeing the effects of the "not giving a damn about anyone but me" philosophy.
